The APPS are available to users free of charge on Google Play (Android) and Apple Store (iOS) and can be accessed through the links provided on our website (https://www.evertus-logistics.com).

By downloading and using the application(s), the user agrees to these Terms and Conditions and acknowledges having read, understood, and consented to our Privacy Policy.

1. Responsible for the All Evertus Logistics Sofware and Web use

2. Purpose

The Term “App” will be used going forward to include “Software, Website, Product or Material”. Our goal is to empower businesses with the tools they need to streamline their supply chain operations, reduce costs, and enhance efficiency.

3. Compatible Devices

The APPS are available for free on Google Play (Android) and Apple Store (iOS). By downloading the APPS, users agree to comply with the terms and conditions set forth by these platforms.

4. Getting Started

Upon launching the APPS for the first time, users may be prompted to provide basic information, such as:

  • Company name

  • Contact details

  • Freight preferences

This information can be modified at any time through the app’s settings panel. Users will initially have access to a free version with limited features, designed to demonstrate the app’s capabilities. To unlock full access, users must subscribe to the Premium version through one of the following payment plans:

  • Monthly

  • Annual

  • Lifetime

Payments are processed securely through Google Play Store or Apple Store, and users are subject to the respective terms of use of these platforms.

5. Method of Use

The APPS provide users with a centralized dashboard to:

  • Track shipments in real-time

  • Manage freight orders

  • Access logistics analytics and reports

  • Receive notifications and updates

5.1 General Settings

Users can customize their experience by:

  • Updating company and contact information

  • Configuring notification preferences

  • Managing their subscription plan

  • Accessing FAQs, Terms of Use, and Privacy Policy

5.2 Freight Categories

Through the Categories menu, users can:

  • Specify preferred freight types (e.g., refrigerated, hazardous, oversized)

  • View saved or frequently used shipments

  • Create custom freight profiles

5.3 Themes

Users can personalize the app’s appearance by selecting:

  • Font styles

  • Color schemes

  • Background themes

6. Intellectual and Industrial Property Rights

The intellectual and industrial property rights over the APPS are owned by Evertus Logistics, which holds exclusive rights to exploit them in any form, including but not limited to reproduction, distribution, public communication, and transformation.

Users acknowledge that any unauthorized reproduction, modification, distribution, commercialization, decompilation, disassembly, reverse engineering, or publication of any elements within the APPS constitutes an infringement of Evertus Logistics' intellectual property rights. Users agree not to engage in such activities.

6.1 User Content

Through the APPS, users may create and share content related to freight management, logistics optimization, and other operational data (hereinafter, "User Content").

By posting User Content, users represent and warrant that:

  1. They own the User Content or have the right to use it.

  2. The User Content does not violate the privacy rights, publicity rights, copyrights, contract rights, or any other rights of any person or entity.

Evertus Logistics reserves the right to terminate the account of any user who infringes these rights.

Users retain ownership of their User Content but grant Evertus Logistics a non-exclusive, worldwide license to use, modify, publicly perform, publicly display, reproduce, and distribute such content through the APPS.

7. Privacy Policy

In compliance with applicable data protection regulations, Evertus Logistics informs users that any personal data provided through the APPS, email, or other communication channels will be processed by Evertus Logistics as the Data Controller.

7.1 What Personal Data Do We Collect?

We also automatically collect:

Personal data is processed by Evertus Logistics, a fully licensed and insured freight brokerage.

  1. Provision of Services: To manage freight operations, track shipments, and provide logistics solutions.

Data is retained only as long as necessary to fulfill these purposes and is securely deleted afterward.

The APPS are intended for use by adults. Evertus Logistics does not knowingly collect data from minors. If we become aware of such data, it will be promptly deleted.

The APPS may experience temporary interruptions due to:

Evertus Logistics is not responsible for:

  • Loss or damage resulting from APPS failures, breakdowns, or blockages.

  • Improper or inadequate use of the APPS by users.

If users are dissatisfied with the APPS or services, their sole remedy is to discontinue use.

9. Invalidity of Clauses

If any clause in these Terms and Conditions, Privacy Policy, or other applicable policies is deemed invalid or unenforceable, the remaining provisions will remain in full effect. The invalid or unenforceable clause (or part thereof) will be treated as if it were not included.

10. Governing Law and Jurisdiction

Any disputes related to the APPS, services, or these Terms and Conditions will be governed by the following:

  1. For Business Users: Disputes will be resolved under the laws and jurisdiction of the State of Florida, United States.

  2. For Individual Users: Disputes will be resolved under the laws and jurisdiction of the user’s country of residence.

11. Contact Us and Communications

By using the Contact Us option, you voluntarily authorize Evertus Logistics to:

  • Save your contact information (e.g., name, email, phone number).

  • Reach out to you via email, SMS, or phone call regarding your inquiry or for follow-up communications.

You acknowledge that by providing your contact information, you are opting in to receive communications from Evertus Logistics. If at any time you wish to stop receiving communications, simply reply with “Opt-Out” or “Stop” to the message or email. Upon receiving your request:

  • All your data will be permanently deleted from our active systems.

  • Your information will be added to our Do Not Call (DNC) file to ensure compliance with your request.

  • Your privacy will be respected, and no further communications will be sent.

Evertus Logistics is committed to maintaining compliance with all applicable privacy laws and regulations.

SMS/MMS Messaging Compliance

1. Consent & Participation
By opting into SMS/MMS communications, you agree to receive automated messages from Evertus Logistics related to freight updates, load alerts, and customer support. Message frequency varies based on activity.

2. Opt-Out Instructions

  • To stop receiving messages, reply STOP to any SMS. Opt-out requests are processed immediately.

  • For help, reply HELP or visit Evertus Logistics Support.

3. Data Protection

  • We do not share, sell, or lease your phone number or SMS/MMS data to third parties for marketing purposes.

  • Data is used solely for transactional and service-related communication.

4. Costs & Privacy

  • Standard message and data rates may apply (check with your carrier).

5. Compliance
We adhere to the Telephone Consumer Protection Act (TCPA) and CTIA guidelines. Unauthorized SMS use (e.g., spam) violates our policy

12. Liability Reminder

As a fully licensed and insured freight brokerage, Evertus Logistics ensures that all services provided through the APPS meet the highest industry standards. However, users acknowledge that the APPS are provided "as is," and Evertus Logistics is not liable for any indirect damages arising from their use.

13. Termination

Evertus Logistics reserves the right to terminate access to the APPS for users who violate these Terms and Conditions. Users may also terminate their subscription at any time through the app’s settings or their respective app store account.
